Expanse triggering cooldown even when "used" ability has no effect

By socketing the expanse gem into pain offering, if you do not have an eligible minion near enough to the cursor on cast, the cooldown is triggered without actually creating an offering spike.

This seems like it should fizzle the spell rather than trigger the cooldown.
