Unable to res even though not in a party

My witch is currently at the start of act 2 by Rathbreaker. I was in a party earlier with a friend but we disbanded the party back in act 1. When I died on rathbreaker I was unable to res the game still thinks I'm in a party when I'm not. If I get my friend to join my party after I restart the game and it puts me at the checkpoint he is unable to warp to me and he cannot see my portal at the caravan in town.

Any ideas for this. My game just did a update of around 800mb do not sure if this has anything to do with it.
