Despair stops working for no reason at level 17

Using despair, works fine with level 15 gem but when I bought a 17 and upgraded it suddenly it wont work, all requirements are met, tried removing all support gems, relogging and nothing seems to work, skill is completely gone from skill bar when using level 17 variant.

Thanks for posting this I was losing my mind. It works in my primary, but not my secondary weapon set. It seems to break from global modifiers that take it above level 17 too. Super frustrating. I had to recraft a lower level and it works now ... a fix would be nice.

Just kidding, doesn't seem to want to work at all in second weapon set, super frustrating.
