weapon switch issue

I have a problem where my cast on crit would not activate on weapon switch to set 2. It says no socketed skill. The attributes and spirit are fine.
I have narrowed it down to the following porcedure:

2 empty weapon sets:

I equip my spear and sceptre (it has dex on it) in weapon set I -> everything activates.

I unequip both spear and sceptre.

I manually switch to the empty weapon set II.

I equip the same spear and sceptre -> Cast on Crit wouldnt activate, Herald active with an exclamation Mark saying the skill cannot be used with the current setting for the weapon set.

I have no weapon set points allocated.

OK i got it, it is the Quality on the Cast on Crit that prevents it from being used in weapon set II for whatever Reason. Making a new one without Qaulity works, sucks though i am missing 5 Spirit now. It wasnt working when i freed up more spirit by deactivating skills though.
Have i found a bug?
