I think that you aren't able to optimize the game; no accesibilty with mini test without size font modifier, no loot filter, no keyboard and mouse support on console, no warrior buff, no minion AI fix, no free respec for passive threes, many crashes... If you've been getting hard crashes or other game breaking bugs that actually keep you from playing, then sure you deserve a refund.
