Maybe its because im from the UK, if you put out an advert for a product that showed and promoted something visually and verbally but it wasnt included in the price yet, you would have to say so clearly in that advert, or the ad would be banned as misleading.
Pulled up some litigation regarding filing a misleading advertisement with the ASA in the UK. Also looking through rulings related to Promotional/Advertising Early access games on the ASA website, I would assume they have documentation related to Early Access games. I personally don't think the trailers and gameplay mislead anyone to an egregious amount right?
I played the POE 2 Demo at PAX East 2024 and it felt pretty similar to the EA so..
I've seen pretty horrendous false promises from 7 Days to Die devs who had one of the kickstarter promises being Adding Bandit NPC's and lo and behold its been like 8-9 years and still no "Bandit NPC's" They went into full release and haven't completed their kickstarter goals

You are missing the point, that video was used to specifically promote the sale of EA keys and therefor a casual viewer would legitimately expect that what was shown in that video would be available if you purchased an EA key.

I have no intention of asking for a refund or anything else, im just saying its misleading, its obviously misleading, and the only reason to include it in the video is to encourage people to buy an EA key despite the fact that that specific feature wont be available for several months, maybe longer. All they had to do was say "While not available at EA launch, we are working on adding the Spectre Gem as soon as possible." but that TRUTH would have potentially harmed Sales and/or the general "hype" of the launch trailer. Therefore it IS intentionally misleading.
